{"id":4296,"date":"2025-11-05T09:24:21","date_gmt":"2025-11-05T08:24:21","guid":{"rendered":"https:\/\/www.we4cr.com\/?p=4296"},"modified":"2026-03-24T11:48:50","modified_gmt":"2026-03-24T10:48:50","slug":"ai-medical-device-regulation-2026","status":"publish","type":"post","link":"https:\/\/www.we4cr.com\/it\/ai-medical-device-regulation-2026\/","title":{"rendered":"Pronti per la prossima bozza: cosa cambier\u00e0 nella regolamentazione dei dispositivi medici basati sull'intelligenza artificiale entro il 2026"},"content":{"rendered":"<p class=\"wp-block-paragraph\">\u00c8 in corso una rivoluzione silenziosa nel modo in cui regolamentiamo l\u2019intelligenza artificiale in medicina.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">Per anni, la conversazione si \u00e8 concentrata sulla <strong>validazione<\/strong>: raccolta dei dati, misurazione delle prestazioni, definizione dei protocolli, dimostrazione che il modello funziona.<br>La logica era lineare: se funziona, pu\u00f2 essere certificato.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">Ma il 2026 segna un punto di svolta.<br>Non sar\u00e0 pi\u00f9 sufficiente dimostrare che un algoritmo funziona \u2014 sar\u00e0 necessario dimostrare che <strong>continuer\u00e0<\/strong> a funzionare nel tempo, in contesti reali, su pazienti, dati e condizioni eterogenei.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">I modelli di IA non sono pi\u00f9 sistemi statici. Sono dinamici, adattivi, apprendono costantemente da nuovi dati.<br>Ci\u00f2 significa che la domanda regolatoria sta cambiando: da <em>\u201cIl modello \u00e8 valido ora?\u201d<\/em> a <em>\u201cSiamo in grado di governarne l\u2019evoluzione?\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Dalla validazione alla governance.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">Questo non \u00e8 un cambiamento teorico. \u00c8 gi\u00e0 previsto nei prossimi quadri normativi \u2014 l\u2019<strong>EU AI Act<\/strong>, le <strong>linee guida EMA<\/strong> sull\u2019uso dell\u2019IA e il <strong>Predetermined Change Control Plan (PCCP) della FDA<\/strong>.<br>Tutti convergono su un messaggio: <strong>la conformit\u00e0 non \u00e8 pi\u00f9 un evento una tantum, ma un processo continuo che deve accompagnare l\u2019algoritmo lungo tutto il suo ciclo di vita.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">Fino a poco tempo fa, il software era trattato come un prodotto finito \u2014 validato una sola volta, con parametri fissi, rilasciato come versione stabile.<br>Questo approccio non \u00e8 pi\u00f9 applicabile ai modelli di machine learning adattivi e auto-aggiornanti. Questi possono migliorare \u2014 ma possono anche deviare. E ci\u00f2 che non si governa, non si pu\u00f2 controllare.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Questo solleva nuove questioni pratiche che gli enti regolatori stanno gi\u00e0 affrontando:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Come garantiamo la sicurezza quando ogni aggiornamento modifica il comportamento del modello?<\/li>\n\n\n\n<li>Come distinguiamo miglioramenti reali negli esiti clinici dal semplice rumore statistico?<\/li>\n\n\n\n<li>Come aggiorniamo la documentazione regolatoria quando il modello evolve?<\/li>\n\n\n\n<li>E, soprattutto, come monitoriamo i rischi e le prestazioni una volta che l\u2019algoritmo \u00e8 distribuito nella pratica clinica \u2014 oltre lo spazio controllato di uno studio clinico?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">Il messaggio degli enti regolatori \u00e8 chiaro e logico:<br>non conta solo <em>quanto innovativa<\/em> sia la vostra IA, ma <em>quanto responsabilmente riuscite a governarla nel tempo<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">La FDA ha gi\u00e0 formalizzato questo approccio attraverso il <strong>PCCP<\/strong>, richiedendo alle aziende di non limitarsi a \u201creagire\u201d al cambiamento, ma di <strong>progettare per il cambiamento<\/strong> \u2013 prima dell\u2019approvazione, prima della commercializzazione.<br>Ci\u00f2 significa definire in anticipo <em>quali<\/em> componenti del modello potranno evolvere, <em>come<\/em> saranno monitorate e <em>come<\/em> la sicurezza sar\u00e0 preservata in ciascuna iterazione.<br>Il cambiamento non \u00e8 pi\u00f9 soltanto un rischio; \u00e8 parte integrante del design.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">L\u2019Europa sta muovendosi nella stessa direzione. A norma dell\u2019<strong>AI Act<\/strong>, i sistemi ad alto rischio (tra cui i dispositivi medici basati su IA e i software di supporto alle decisioni cliniche) devono essere spiegabili, tracciabili e monitorati in modo continuo.<br>L\u2019<strong>EMA<\/strong> va ancora oltre: l\u2019IA non deve solo <em>funzionare<\/em>; deve essere <em>comprensibile, controllabile e giustificabile.<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Cosa significa tutto questo per sponsor, startup e aziende del settore medtech?<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">Significa che la validazione di un algoritmo \u00e8 solo l\u2019inizio.<br><strong>Governarlo<\/strong> \u00e8 la vera responsabilit\u00e0 \u2014 e il vero vantaggio competitivo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Questo richiede:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Una governance dei dati in grado di prevenire deriva e bias<\/li>\n\n\n\n<li>Sistemi di qualit\u00e0 in cui gli aggiornamenti sono integrati nel ciclo di vita del prodotto<\/li>\n\n\n\n<li>Generazione di evidenze che includa dati del mondo reale, non solo protocolli clinici<\/li>\n\n\n\n<li>Monitoraggio post\u2011immissione sul mercato continuo, integrato fin dal primo giorno<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">In questo contesto anche il ruolo delle organizzazioni di ricerca clinica sta evolvendo.<br>Non pi\u00f9 CRO che si limitano a \u201cgestire studi\u201d, ma CRO che <strong>accompagnano gli algoritmi nel tempo<\/strong>: aiutano gli sponsor a costruire non solo <em>evidenze<\/em>, ma anche <em>governance<\/em>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">In We4 Clinical Research, non vediamo un algoritmo come un prodotto statico.<br>Lo vediamo come un organismo vivente \u2014 qualcosa che impara, si adatta e cresce.<br>E proprio per questo ha bisogno di essere accompagnato, non solo certificato.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">Se state sviluppando o gestendo un dispositivo basato su IA, questo non \u00e8 un problema del futuro.<br>\u00c8 la domanda che definir\u00e0 la vostra competitivit\u00e0 nei prossimi anni.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\"><strong>La validazione non \u00e8 sufficiente.<br>La governance \u00e8 la nuova frontiera.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/l.we4cr.com\/j-7l\">Parliamone insieme.<\/a><\/p>","protected":false},"excerpt":{"rendered":"<p>There\u2019s a silent revolution underway in the way we regulate Artificial Intelligence in medicine.
